User Privacy
This Privacy Policy ("Policy") explains how your personal information is collected, used and disclosed by Wayups, Inc. This Policy applies both to the Wayups.com website, and any other online or mobile applications and services operated by Wayups, Inc. (the “Site”). The Site allows you to meet and interact with new people, and communicate with people you already know. As you would with any other website where you register and provide information about yourself and your opinions, it is advisable to pay attention to your personal information, and how it is used. Wayups, Inc. understands this and has created this Policy to clearly explain how information is collected, and how this information may be used.
Children's Privacy & Safety is very important to us
Wayups is a general-audience website operating in full compliance with the Children’s Online Privacy Protection Act (COPPA). The Site’s registration process forbids children under age 13 from becoming members of the Site, and from utilizing the Site. If Wayups receives information suggesting that a registered user is under age 13, we will demand the user provides evidence confirming that the user is at least 13 years old. If within 48 hours the user fails to provide such evidence, the user’s account will be immediately terminated. Furthermore, all personally-identifiable information displayed on the Site will be immediately nullified.
Additionally, because The Site is a general-audience website, absolutely no nude or pornographic material will be allowed on the Site. No exceptions.
Wayups Collects User Information
Personally-Identifiable User Information
We will collect information about you in multiple ways when you visit our Site. This information includes personally-identifiable information provided to us (by you) when you register on the site: your name, email address, ZIP code, user-chosen password, date of birth and other personal information. During the registration process, Wayups will email a validation message to each new user, with a URL link-back to the Site. This URL will contain a user-specified identifier and passcode, allowing us to confirm the user’s identity. Wayups may also obtain information from other sources, combining that with information collected on the Site. Wayups may store / process personally-identifiable information in the US and in other countries.
Passive Data Collection & “Cookies”
Each time you visit our Site, some information is collected automatically. This information includes: clickstream data, IP address, access times, browser type, operating system, page views and website visited immediately before visiting our Site is automatically logged. Once within the Site, a User ID may be placed in the URL, allowing customized features for that user. Users should also be aware that other websites visited before entering Wayups might place personally-identifiable information within a user's URL while visiting their website—something Wayups has no control over. As such, a portion of this information may be logged by a later website that collects URL information.
Besides standard log information, Wayups uses multiple state-of-the-art technologies to “personalize” experience for users. An example of this is the automatic collection of information via “cookies." Cookies are small data files sent by websites to users’ browsers and hard drive that identify the computer to the website. Wayups employs cookies to create enhanced features: for example, registered users don’t have to retype their passwords before reentering the Site. Cookies may also be used to produce customizable user content, when available. Users often have the option to disable cookies (from within their Internet browsers) and continue to use the Site. Removing or rejecting cookies can affect certain features or services on the Site.
Wayups may also collect information using Pixel tags, tiny graphic files embedded in HTML-encoded email messages. Pixel tags are used to gather information about emails sent to registered users. When such a message is opened in an HTML-capable email program, the receiver’s computer accesses our server to retrieve the Pixel tag, allowing us to record and store the date, time, recipient’s email address, and other logging information. The Pixel tag also may read cookies. Wayups web pages may also contain Pixel tags allowing us to count users, compile aggregated statistics about site usage, and deliver cobranded services when applicable. Wayups Pixel tags collect a limited amount of information: a cookie number, time and date of a given page view, and an identifier of the page on which the Pixel tag is located.
Wayups websites may contain Pixel tags placed by 3rd-party ad servers, monitoring the effectiveness of their advertising initiatives. Wayups does not have access to, or control over, advertisers' cookies / Pixel tags or how they may be utilized.
Document Retention Policy
All personal information collected by Wayups including, without limitation, your name, location, email address, pictures, friend connections, messages, comments, login information, IP addresses and other data, will be stored for as long as reasonably necessary for the purposes for which it was collected and / or to comply with all applicable legal reporting or documentation retention requirements.
How Wayups Uses User Information
Personally-Identifiable Information
We use personally-identifiable information collected via our Site for the purposes describe in this Policy and on the Site. Personally-identifiable information such as members' pictures and names are displayed to people in order to facilitate user interaction on the Site. Email addresses are employed, among other purposes, to invite new friends to join the service, and to add users to members’ friends’ networks. To expedite searching and finding friends on the Site, users may search for other members via first and last name, email address, location and schools attended.
Wayups may also use email addresses to send useful information to all registered users regarding the Site, including news about products, services, and partnerships offered. Sometimes, we offer users an opportunity to send friends an invitation to join Wayups. This can be done by entering the friend’s email address—or by importing an address book and selecting specific email addresses. The result is an email being sent from the registered user to the referral address, inviting the referral to register. When the referred person does not sign up within a few days, we may also send periodic reminders from the registered user to referred address. All registered users will be able to view other users’ stats, profile, comments, photos, friends, updates, tags, videos, groups, questions, gifts, and friend list. Occasionally, Wayups may share email addresses / personally-identifiable information of registered users with 3rd-parties for marketing purposes, to target advertising and to improve user experience across Wayups in general. Wayups may also link or combine with other personal information we get from 3rd-parties, to better understand users’ needs, and provide increased levels of service.
Cookies and Passive Data Collection
Wayups uses cookies, IP address, clickstream and URL information to improve Site content, server-quality, and provide enhanced features to users. We use cookies to save UserIDs, session validators, and on users' browsers and hard drives. We may use them to provide tailored products or services to those users. We may also cross-match user information with information collected from cookies and clickstream data to test Site features, and increase personalization of various offerings. IP Addresses also help Wayups diagnose server problems, to provide site administration, and provide services to users. IP addresses may be disclosed to a 3rd-party when law or legal process so requires, or to protect the rights or property of Wayups or others. Occasionally, Wayups may extend offers from partner-companies, such as news or additional details on products and services. Furthermore, a user's usage history may result in specifically=tailored special offer screens or products. Wayups may produce aggregate reports for advertisers—including the number of users who clicked on an ad, or the number of users visiting different potions of the Site.
Profile Information
Wayups enables members to post information to a profile and other portions of the Site accessible to other users. This profile information is used to provide our services to you—to analyze demographics, personalize user-offerings, and enable other users to locate your profile. All information, including personally-identifiable information, disclosed by users in their public profile and other parts of the Site are available for others to see on the Site. DO NOT POST direct contact information anywhere on the Site, including your email addresses, URLs, instant messenger IDs, phone numbers, full names, or addresses. We also caution you to never share sensitive information (such as your social security or credit card numbers) with other users. You are aware that when you publish content or information via the "everyone" setting, you are allowing everyone—including people off Wayups—to access that information and associate it with you.
Sharing Your Content & Information
Wayups enables users to upload and share content and information. You remain the owner of all content and information you post, and have the power to control how it is shared via your privacy settings. For content that is covered by intellectual property (IP) rights—such as photos, videos and written compositions –you specifically give Wayups the following permission: you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any IP Content posted on / in connection with Wayups (“IP License.”)
For example, Wayups may make commercial use or otherwise display your name and / or IP Content in or in connection with endorsements or advertisements promoting Wayups. This IP License ends when you delete your IP Content or your account, unless your IP Content has been shared with others, and they have not deleted the IP Content. When you delete IP Content it is removed from the Site. However, we may maintain backup copies of the IP Content as part of our document retention policy.
Invitations
The Invite Friends feature makes it easy for Wayups users to invite friends via email. The email addresses you supply to use this service may be used to send invitations and invitation-reminders, to connect with you on Wayups.
Surveys & Contests
Occasionally we will offer surveys or contests to users. Surveys may ask for contact, demographic or unique identifying information to increase the results’ value. Contests may require contact information or other demographic or personally-identifiable information to determine eligibility. Wayups may use the information collected from surveys and contests to entertain users, and to determine, notify and contact contest-winners. Furthermore, demographic and / or personally-identifiable information and survey- / contest-responses may used by Wayups or shared with 3rd-parties to help provide custom-tailored advertisements. Wayups will not share a user’s email address with 3rd-parties unless the user specifically opts-in to such sharing while completing a survey or registering for a contest.
3rd-party Links & Ad Servers
You must be aware that links to 3rd-party websites and ad server advertisements found on Wayups may or may not use cookies, Pixel tags and web tags. Wayups provides links to 3rd-party websites, which may or may not use cookies, Pixel tags and web tags. Ad servers may also use these tools to compile information including where users saw particular advertisements, and to determine which ads were clicked on. We are not responsible for, or have any control over, the privacy policies of 3rd-party websites and ad servers. We encourage all users to read the privacy policies of each and every website visited when linking directly from Wayups.
Protection of Wayups & Other Parties
Wayups may, at times, disclose personally-identifiable information when required to do so by law, or in good faith that such disclosure is reasonably necessary to respond to subpoenas, court orders, or other legal process. Wayups may also disclose user-information to law enforcement officers in good faith belief that this disclosure is reasonably necessary to: enforce our Terms of Service, respond to claims that any posting / content violates the rights of 3rd-parties, respond to user requests for customer service, or protect the rights, property, or safety of Wayups, its users, or the public-at-large.
Security
Wayups employs industry-standard security measures to protect the loss, misuse or alteration of the information under our control. While we make a good faith effort to store the information we collect in a secure operating environment unavailable to the public, we cannot guarantee complete security. Furthermore, while we make every effort to ensure our networks’ and systems’ integrity and security, we cannot guarantee that our security measures will prevent 3rd-party "hackers" from illegally obtaining this information.
Updating or Removing User Information
Registered users may at any time elect to correct or update the information submitted to us. Simply:
1. Log in to your Wayups account.
2. Click the "Account" link on the top right-hand corner.
3. Change or edit any information you wish.
4. As a registered user, you may at any time cancel your account.
Opt-Out Opportunities
Users can manage their mailing preferences, by specifying which type of email to opt-out of on their Account Settings page. Simply log-in and un-check the boxes under the Email Preferences section indicating which type of email you don’t want to receive. Canceling an account entirely also prevents a user from receiving future communications from Wayups. Wayups will not share the user's information with 3rd-parties for marketing purposes. However, you may still receive a user-generated invitation from friends asking you to join Wayups.
Strict No-Spam Policy
At Wayups we hate spam. Thus our Strict No-Spam Policy prohibits all users from engaging in any activity involving spam on our Site. Violation of this policy may result in immediate termination of service and legal action against any spammer. Wayups’ Terms of Service expressly prohibits users from uploading, posting, emailing, transmitting or making available junk mail, commercial advertisements, or other commercial solicitations via the Site. Any violation of this policy is also a violation of certain federal and state laws, including the Computer Fraud and Abuse Act (18 U.S.C. sect 1030 et seq.) Additionally, since Wayups, Inc. is base in New York City, all Wayups users will be subject to all applicable New York City and New York State laws. Such violations may subject the sender and his or her agents to civil and criminal penalties.
Other Disclosures
Change of Ownership
In the event of an ownership change or a direct merger or acquisition with another entity, Wayups reserves the right to transfer all of Wayups’ user information, including email / postal addresses, to a separate entity. All registered users will be notified of any change in ownership, merger or acquisition of Wayups’ assets by a 3rd-party via email notice, and may choose to modify any of their registration information at that time.
Revisions to This Policy
Wayups reserves the right to change, revise, amend, or modify this Policy from time to time. If any changes are made, we will change the “Updated as of” date above.
